LEGAL BASIS PROMOTION "SWATSHIRT VOLL-DAMM WE ARE NOT FRIENDS"

1.- PROMOTER AND SUBJECT-MATTER OF THE PROMOTION
S.A. DAMM, registered office at c/ Roselló, 515, Barcelona, and holder of Tax Identification Code (CIF) A08000820, is organising a promotion called "VOLL-DAMM SWEATSHIRT BY WE ARE NOT FRIENDS " (hereinafter, the “PROMOTION”) with the purpose of encouraging responsible drinking and promoting the distribution of products marketed under the “VOLL-DAMM” trademark which is owned and registered by S.A. DAMM. This promotion will be governed by these Terms and Conditions.

2.- GEOGRAPHICAL LIMIT OF THE PROMOTION AND ELIGIBILITY
The PROMOTION is addressed to end consumers who acquire 20 collars of 20 cl and 33 cl Voll-Damm bottles in participating hospitality establishments.
Anyone over 18 years of age residing in Spain (with the exception of the Canary Islands) is eligible to enter the PROMOTION.
S.A. DAMM employees, distributors, their relatives and anyone directly or indirectly involved in setting up and running the PROMOTION are expressly excluded from entering this PROMOTION.
Entries which do not meet all or one or more of the specified requirements will be automatically disqualified even if they are winners.

3.- TIME LIMIT OF THE PROMOTION
The PROMOTION will start on 3 May 2024 and end on 10 September 2024, both inclusive. No entries will be accepted after the closing date.

4.- HOW TO ENTER AND PRIZES.
The end consumer has to redeem 20 codes on the website www.damm.com/volldammpromo. The codes are on the collar of VOLL-DAMM beer bottles sold from 3 May 2024 within the specified geographical area.
The first 10,000 end consumers who redeem the 20 codes can get a limited edition VOLL-DAMM sweatshirt designed by WE ARE NOT FRIENDS, 4,000 in size S/M and 6,000 in size L/XL and worth €75 each.
Starting from end consumer 10,001 (including end consumer 10,001), entrants who redeem 20 codes on the website www.damm.com/volldammpromo in the promotional period stated in Clause 3 above will be entered in a draw for 4,000 sweatshirts in size S-M and 6,000 sweatshirts in size L-XL.
This draw will be held on 15 September 2024 before the Notary of the Professional Association of Barcelona Mr Jose-Alberto Marín Sánchez at Diputació 268, entlo, Barcelona.
Instant winners who are unable to get a sweatshirt in their chosen size because stocks have run out will have the option of choosing an alternative size or waiving the prize and entering the draw to be held on 15 September 2024 before a notary with the chance of winning a sweatshirt in their chosen size.

In the code redemption procedure on the promotional website www.damm.com/volldammpromo, the end consumer will be asked for the following data solely for purposes related to this PROMOTION:

Name and surname(s)
Address, province and postcode
Date of birth
Contact phone number
Sweatshirt size
Once the winners have been chosen, we will contact them from 19 September until 30 September 2024 via the email address provided when registering for the PROMOTION. If the prize is not claimed, S.A. DAMM reserves the right to select additional winners or may declare the prize void and dispose of it as it sees fit.
S.A. DAMM reserves the right to ask for the 20 original promotional collars entered at the time of registration. If they have been tampered with, are a photocopy or have been lost, or the collar number has been used to enter any other promotions S.A. DAMM may run at the same time as this promotion or they do not meet one or more of the requirements specified in these Terms and Conditions, the entrant will forfeit the prize.

6.- DISCLAIMER
S.A. DAMM accepts no liability for any incidents caused by faults in the computer program, cases of force majeure or any other event beyond its control. It also declines any liability if an end consumer is unable to register due to errors in the capture of their personal data.

8.- PERSONAL DATA PROTECTION
Entrants’ data will be processed by S.A. DAMM to manage the promotion and award the prizes. By entering, entrants agree to the processing of their personal data pursuant to applicable regulations.

9.- RESERVATION OF RIGHTS AND RESTRICTIONS
S.A. DAMM reserves the right to cancel, suspend or amend the PROMOTION on technical grounds or due to reasons beyond its control. It may also declare the PROMOTION void if it finds any irregularities in the entrants’ data.

10.- GOVERNING LAW AND JURISDICTION
The promotion will be governed and construed in accordance with Spanish law. Any disputes will be submitted to the competent courts. S.A. DAMM reserves the right to take legal action against any attempts to tamper with or falsify the PROMOTION.

11.- ACCEPTANCE OF THE TERMS AND CONDITIONS
By entering the draw, entrants accept these Terms and Conditions. Any refusal to do so will entail the exclusion of the entrant from the PROMOTION and S.A. DAMM will be released from its obligations.
The Terms and Conditions are filed with the Notary of the Professional Association of Barcelona Mr Jose-Alberto Marín Sánchez at Calle Diputació, 268, entlo, Barcelona, and are available in the Ábaco (Notarial Archive of Competition Terms and Conditions) register.
